1. Road traffic (CH)

In road traffic, it is not the rapid test that decides, but the blood values.

Procedure for inspection:

  1. Screening (saliva / pre-test)
  2. Suspicion confirmed → blood sample
  3. Laboratory analysis (LC-MS/MS)
  4. Evaluation based on active ingredients

THC limit in Switzerland

  • 1.5 μg/L active THC (serum) → unfit to drive, criminally relevant

Zero Tolerance:
Cocaine, amphetamines, methamphetamine, MDMA, heroin/morphine (without prescription)

2. Workplace

Drug testing is only allowed if:

✔ Security-related activity
✔ reasonable suspicion
✔ Clear internal guidelines
✔ Data protection complied with
✔ Consent available

Not allowed:

  • Groundless tests in the office area
  • pure curiosity
  • Tests without consent

In case of positive screening:
always require laboratory analysis

3. Private use

Drug tests may be used privately:

✔ for self-control
✔ in the case of minor children (duty of supervision)
✔ for prevention in the environment

Inadmissible:

  • Secret testing of adults
  • Sample manipulation
  • Compulsory tests

4. Confirmatory analysis (laboratory)

A rapid test alone does not create a legal obligation.

The only legal validity is:

  • LC-MS/MS Laboratory Analysis
  • Precise determination of active ingredients
  • No cross-reactions
  • Legally binding

Only then are measures, penalties, or labor law steps possible.

Data Protection & Documentation

The following apply to testing:

  • Purpose limitation of data
  • Access only for authorized persons
  • no disclosure without consent
  • Define deletion deadlines
